Age-Based Workplace Discrimination

Have you been discriminated against in the workplace due to your age? In order to have a potential age discrimination claim under federal law, you must be at least 40 years old. A different age range can bring about a claims in New Jersey under the state’s Law against Discrimination (LAD). It protects employees from age discrimination as long as he or she is between 18 and 70 years old.

In addition to meeting the age requirement, you must have been adversely affected by an employment action. For instance, you were terminated or did not received a promotion you were qualified for due to your age. Your potential claim may also depend upon the number of employees at the employer. For example, under the federal law there must be twenty or more employees.
